Bombay High Court quashes FIR accusing husband of domestic abuse filed by wife, after amicable settlement between couple

 

 

New Delhi, November 25, 2020: The Bombay High Court quashed an FIR citing domestic abuse by husband after the complainant-wife voluntarily confirmed that the couple had reached an amicable settlement on Wednesday.

 

The Bombay High Court Division Bench of Justice SS Shinde and MS Karnik even deemed it unnecessary for advocate AB Patil, who was appearing for the wife, to make any further legal submissions. Justice Karnik told Patil on a lighter note - Haven't you heard of the saying, "Jab Miya Biwi Raazi...?", After interacting with the wife over the video conference to confirm her voluntary consent to quash the FIR, the Court was informed that the couple was under tremendous work pressure as they were both medical professionals employed in hospitals. The Court agreed with her submission that due to the ongoing pandemic, medical professionals were under stress. "We have highest regard for doctors and we know how much pressure they work in", Justice Shinde chimed in.

 

Accordingly, The wife informed them that the FIR and an additional domestic violence case came to be filed due to certain mis understandings between the couple. She apprised the Court that the couple had been residing together peacefully since September 2020, and she was praying to the Court to quash the FIR without any coercion. The Court acceded to the request after it was satisfied that the wife will not support the allegations in the FIR and, consequently, chances of conviction are bleak.
